PRIVACY POLICY

The Indie Privacy Policy as January 15, 2006

I. Information We Collect

We receive and collect certain information. The information that we receive and collect depends on what you do when you visit The Indie or its affiliated websites.

Automatically Collected Information:
We receive and collect the name of the domain and host from which you access the Internet; the Internet protocol (IP) address of the computer you are using; the browser software you use and your operating system; the date and time you access our site; and the Internet address of the website from which you linked directly to our site. We use this information to monitor the usage of our site. Also, when we send emails to you, we may be able to identify information about your email address, such as whether you can read graphic-rich HTML emails.

Information Collected via Cookies:
We may use "Cookies" to enhance your experience on The Indie or its affiliated websites. "Cookies" are small files or records that we place on your computer's hard drive to collect information about your activities on The Indie or its affiliated websites. The cookies transmit this information back to our computers or our third-party distributors of banners and newsletters; these computers are, generally speaking, the only computers that are authorized to read such information. The information captured makes it possible for us (i) to speed navigation; keep track of items in your playlist, account profile, and search agents; and provide you with custom tailored content; (ii) to remember information you gave to us so you don't have to re-enter it each time you visit The Indie or its affiliated website; (iii) to monitor the effectiveness of certain of our marketing email campaigns; and (iv) to monitor total number of visitors, pages viewed, and the total number of banners served.

Information You Actively Submit to The Indie:
For most of the browsing services we provide, we neither require nor save" Personal Customer Information"- your name, email address, billing address, shipping address, phone number, and credit card information. You can browse The Indie and its affiliated websites as often as you like taking as much time as you want to review our products, services, and/or reviews without having to submit such Personal Customer Information. In the following instances, however, we do need you to actively submit Personal Customer Information: when you want to (i) open a premium account or complete an account upgrade, (ii) submit an image or audio file use on the site, (iii) subscribe to our newsletters, or (iv) participate in a community message board, (v) download or purchase a song, (vi) access restricted areas of the site and/or service.

Creating a The Indie Account:
To create an account, you will need to create a password protected profile. In doing so, we may require that you provide us with the following Personal Customer Information: your name, email address, company address, billing address, mailing address, member bio, and credit card information. We use industry standard eCommerce security technology to protect the Personal Customer Information that you transmit to us when you establish your account and each time you access your account profile. When setting up the account, we ask you to create a password. When you want to update your account profile or change your stored Personal Customer Information, we approve your access by verifying your email address with your password.

Authorization to use your likeness (images) and comments:
If you would like to submit your photo and a personal statement and/or comment, we require that you irrevocably authorize The Indie and its affiliated websites to use your name, image, and any personal statements or comments as the company sees fit, as it appears on any website, affiliate website or partner website, service or application, or for any other promotional purposes that benefits The Indie, or to the account member, no compensation shall be owed or paid to the account member whatsoever. When setting up the account, we ask you to authorize such use as stated above.

Newsletter Subscription:
You may sign up for our free email newsletter-The Indie Reporter-full of recommendations and reviews for resources in music, film, and television. To do so, you will need to "opt in" as a newsletter subscriber at the time you open an account or update your account profile (see Account Settings). You can sign up for our newsletter as a registered user of The Indie. Newsletter subscription contact information is used to forward newsletters only. To unsubscribe, you must "opt out" using the same Account Settings option in your personal profile.

II. Personal Customer Information

Occasionally, The Indie uses Personal Customer Information to market products and services. You can opt out from using your information for this purpose at any time by editing your Account Settings (i.e., deselect "Yes, I would like to receive promotional emails ").

We may share Personal Customer Information that we collect with the following:
Subcontractors: We send Personal Customer Information to third-party subcontractors and agents that work on our behalf to provide certain services. These third parties do not have the right to use the Personal Customer Information beyond what is necessary to assist us. They are contractually obligated to maintain the confidentiality and security of the Personal Customer Information and are restricted from using such information in any way not expressly authorized by The Indie or its affiliated websites.

Service Providers:
We may send Personal Customer Information to third-party providers of goods and services that you may purchase from time to time on our site (e.g., magazines). Like subcontractors, these third parties do not have the right to use the Personal Customer Information beyond what is necessary to assist us. They are contractually obligated to maintain the confidentiality and security of the Personal Customer Information and are restricted from using such information in any way not expressly authorized by The Indie or its affiliated websites.

Membership Programs:
We work with certain companies who, in conjunction with their own membership programs or rewards programs, require that we disclose listening information about their customers who visit The Indie or its affiliated websites via links from the partner sites. We disclose only the information required to make these programs work and support your membership with them, which typically includes the name and/or email address of the user as well as listening habits. We disclose this information to companies under an agreement that requires that they obtain your consent first, usually under the membership or participation rules. If you do not want us to disclose that information to the strategic partner, then you must contact them directly.

Credit Card Companies:
Credit card transactions are handled by a third-party financial institution and their vendors, which receive the credit card number and other personal identifying information only to verify the credit card numbers and process transactions.

Trustworthy Third Parties:
From time to time, on limited bases, we share with trustworthy third parties contact information of our registered customers so that such third parties can promote their products and services. You can "opt out" from using your information for this purpose at any time by editing your account profile (i.e., deselect "Yes - Receive The Indie Promotions").

Law Enforcement Investigations:
The Indie or its affiliated websites may release Personal Customer Information when we believe, in our good judgment, that such release is reasonably necessary to comply with law, enforce or apply the terms of any of our policies or user agreements, or to protect the rights, property, or safety of The Indie, our members, or others.

III. Communications

You may receive the following communications from The Indie:
Transaction and account maintenance activity communications. These communications include without limitation: order confirmations; order update notices; order problem notices; and notices regarding material changes to site policies and account management procedures.

Partner Products and Services Communications:
We send promotional emails and other outbound communications to our members regarding products and services from The Indie, its subsidiaries, and trustworthy third parties. Any member who does not wish to receive such product and service communications can choose to remove his or her contact information from our contact list at any time by editing their account profile. S/he will need to "opt out" (i.e., deselect "Yes - Receive The Indie Promotions ").

Linking to Third-Party Websites:
When you click on links and banners on our site that take you to third-party websites, you will be subject to the third parties' privacy policies. While we support the protection of privacy on the Internet, The Indie cannot be responsible for the actions of any third-party websites. We encourage you to read the posted privacy statement of any and every site you visit, whether you are linking from our site or browsing on your own.
